Statitory Rape: An Overprotective Law

Many young men have been affected by the issue of statutory rape. They have been embarrassed by the ordeal and even imprisoned, as well as marked with the stigma of being a sexual offender. There are those out there who agree with the law and believe it to be perfectly right. However, this law is simply nothing more than an over protective and stubborn law, which needs to be modified for the current times. It has been argued that the law is there to protect young women from older men who would take advantage of them. However, while this might have been a good idea at the time it was passed, it is now creating new victims other than the ones it was meant to protect. The law states that statutory rape is the carnal knowledge (penetration) of a female under the legal age of consent. Whether or not she was a willing participant or not, it does not matter. A large amount of the times that this law comes into effect is in the case of eighteen to nineteen year old guys who were caught with someone as old as seventeen. Does this seem right to you? Some say that the law does not need to change, and that it is still useful in protecting young women today. With my girlfriend of four months who is only seventeen and my eighteenth birthday coming up fast, this will become an issue for me as it has many others and until there are changes made. This would be much fairer seeing as the small gap there would still protect young women from being taken advantage of by the group-men twenty years old and up- that the law was meant for in the first place. This is because the legal age of consent in California is eighteen. Most of the time these girls are their girlfriends and are willingly having sex. They would also be marked as a convicted sex offender and have to report this fact to every police station in the town of his residence. The modification of this law would also take away the use of the law as a tool for vengeful fathers, whom feel that someone has taken their daughter from them. The minimum should be lowered in the case of close age and other similar situations. The teenager can face from one to ten years in prison depending on the age of the "victim" and up to $100,000 dollars in fines. For the sake of myself and your current or future sons I severally hope you feel the same way and take action against this overbearing, outdated law. However, they are overly harsh in most cases. No teenager should have to register that they are a convicted sex offender in every town that they live in just because they had consensual sex with their underage girlfriend.
