Ethics sexual abuse

             This paper will discuss the United States Supreme court decision of Gebser v. Lago Vista Independent School District, 524 US 274 (1998) and the moral concern of sexual harassment by teachers. We will look at the law of Title IX and analyze issues and alternative solutions to prevent future cases of sexual abuse toward students by their teachers.
             In this particular case a high school student and her teacher were discovered having sexual intercourse. The student did not report the relationship to the school authorities. Once this incident was exposed, the teacher was fired and promptly arrested. Gebser, the student, filed a lawsuit against the district and sought damages under Title IX of the Education Amendments of 1972. This school district did not distribute an official grievance procedure for lodging sexual harassment complaints or a formal anti-harassment policy as required by the federal regulations. The Fifth Circuit Court in effect stated that school districts were not liable under Title IX for teacher-student sexual harassment unless an "employee with supervisory power" over the offending employee actually knew of the abuse, had the power to end it, and failed to do so. The Supreme agreed with the Fifth Circuit Court and stated that damages could not be recovered unless a school district official who "at a minimum" had authority to institute corrective measures on the district's behalf had actual notice of, and was deliberately indifferent to the misconduct. Any recovery was against Congress' objective of providing an opportunity for voluntary resolution of any harassment problems.1
             Title IX is a federal law that originated to prohibit gender discrimination in education. In Gebser v.
