Today many Americans are concerned with the ethical responsibilitiesof those working in the criminal justice system. It is important toexplore various codes of conduct for criminal justice professionals, whilecomparing and contrasting the elements of each profession. Lawyers have a written code of conduct which was established by theAmerican Bar Association (ABA). The ABA states a lawyer "shall not * Make a false statement of material fact or law to a tribunal. * Fail to disclose a material fact to a tribunal when disclosure is necessary to avoid assisting a criminal or fraudulent act by the * Fail to disclose to the tribunal legal authority in the controlling jurisdiction known to the lawyer to be directly adverse to the position of the client and not disclosed by opposing counsel. * Offer evidence that the lawyer knows to be false. If a lawyer has offered material evidence and comes to know of its falsity, the lawyer shall take reasonable remedial measures. * The remedial measures continue to the conclusion of the proceeding, and apply even if compliance requires disclosure of information
Many judicialprofessionals are unable to determine if a colleague is being ethical dueto "obsessions with money, needing to play the game and workload(ls. * Performance of duties- officers should be conscientious and diligent in the performance of their duties, and attend work promptly when rostered for duty. " Because of these concerns, the Justice's Office of ProfessionalResponsibility (OPR) was created to investigate Justice attorney'smisconducts and if necessary refer the complaint to the proper authority. This includes information about force policy and operations. * Property- officers must exercise reasonable care to prevent loss or damage to property. There are mechanisms in place to assure thesecodes are followed, however, many professionals are reluctant to report acolleague, thus allowing corruption to continue. * Sobriety- while on duty, an officer must be sober * Appearance- unless on duties which dictate otherwise, officers should always be clean and tidy while on duty. Officers should avoid activities which can retard their return to duty if absent through sickness or injury. Conclusion All criminal justice professionals have a written Code of Conduct, towhich they must adhere. These "canons are: * A judge should uphold the integrity and independence of the Judiciary * A judge should avoid impropriety and the appearance of impropriety in all activities. * Criminal offences-officers must report any proceedings for a criminal offence taken against them.
