China Today laws, government and business environment for the investor

Currently, the China of today has attempted to wrest itself from itsMaoist communist path and embark upon a program of sustained economicreform. Legally, "after expressly declaring to adopt a socialist marketeconomy in 1992," the 8th and 9th National People's Congress of Chinapassed "a series of market-oriented laws" so that "consequently apreliminary legal system accommodating to the market economy came intobeing." (Building China's Market-Oriented Legal System, 2003) In recenthistory, China has indeed practically and legally attempted to bolstermarket reforms and enter the capitalist world economy. However, it is important to note that the National's People's Congr

It has attempted tocreate a nation where political reform is not commensurate with socialreform. Legally, privateownership exists, and is protected, but the government remains involved inthe economy to protect the communist party's own, uni-party interests. essthat passed the aforementioned resolution was not democratically elected bythe Chinese people. China remains a huge market, in terms of its populace, talent, andnational resources, but it remains questionable whether simultaneouspolitical underdevelopment and economic free trade with Western democraticnations can co-exist comfortably. China continues to have a government of control andcommand, politically if not economically speaking. Thisdual program of economic liberalization and political repression beganoften known as China's 'one country, two systems' plan in that a Westerneconomy exists next to a communist political dictatorship of repression. Although the Chinesegovernment asserts that it is reexamining its existing laws and statutes inaccordance with the framework of the World Trade Organization and that ithas abolished certain obsolete laws and regulations, "and will graduallyrevise the laws and regulations that are incompatible with the rules of theWTO" China remains controversial, politically and economically, as a securevenue of trade, although its population and locale makes it almostimpossible to ignore. ("Building China's Market-Oriented LegalSystem, 2003). Furthermore, China remains highlyprotectionist in many of its trade policies. Perhaps the most powerful symbolic statement of this is that in aresolution was passed that allowed that "the private sector is a complementto the socialist public economy," demonstrators in Tieneman Square weremassacred only a year afterward. The party allows freeenterprise and private ownership to exist, provided it does not interferewith party activities through democratic initiatives. Legally, the party administers control China's vast geographic reachescapital, in the form of a single-party system.
