On the whole, this has only affected civil law and trading as opposed to criminal law. Yet some criminal cases can be appealed to the ECJ. The ECJ has the power to strike down national law in favour of community law e.g. R v Secretary of State for Transport ex p Factortame (1991) when the ECJ and the House of Lords suspended the Merchant Shipping Act 1988 as contrary to community law and therefore illegal.
