Plea-Bargaining: Right or Wrong?
Plea-bargaining is an agreement between the prosecution and the accused where the accused person pleads guilty in exchange for a reduced sentence or charge. I agree with plea-bargaining for many reasons, however I also disagree with a few points of it. First of all, it reduces the amount of trials and therefore saves money and time. Also, it offers the accused a choice where they can either take a reduced sentence now or risk getting a longer sentence in court if he is found guilty. However, if they are innocent then they should
Plea bargains also save witnesses who need to testify and jurors from missing work in order to do so. When someone takes the blame, this is usually because someone they love committed the crime or someone has threatened them or their family into pleading guilty. never take a plea bargain because it allows people to believe they are in fact guilty of a crime. The point I don't agree with are that sometimes the prosecution can make the defendant believe there is no way for them to win a trial, so they plead guilty to crimes they didn't commit in order to get a lesser charge. Basically, pleas help with clearing the overcrowded court systems. Also, defendants take please in order to avoid publicity, having a less serious offense on their record, to avoid hassles, resolve matters quickly, get out of jail or to take the rap for someone else who actually committed the crime. In violent crimes, like murder, rape, assault or domestic violence, the defendant should be sent to trial. In other crimes, like burglary and car theft, plea bargains should be considered because those crimes didn't physically hurt anyone. About 95% of all felony convictions in the United States are results from plea bargains. I don't believe plea bargains should always be accepted. In the end though, it should be up to the prosecutors and judges to determine what crimes can be plea-bargained and what ones can't because they have more experience than most people on crimes.
