Juveniles charged as adults
I. The history of juvenile crime and punishment in AmericaA. All the way back to the early European Settlers1. They believed children 7-13 yrs. old understood the difference between right and wrong2. Could be punished severely for crimes as minor as disrespect to their parents 3. Many children were put in adult prisons4. Adolescents 14 yrs and up were regarded strictly as adults. Some sentenced to death. B. Young offenders treated as adults continued through the 18th centuryC. The 19th century people began to feel compassion for juveniles. D. In 1899 the first juvenile court system was established in Cook County, IL1. For those of you unfamiliar, this is one of the harshest counties in the United States. E. The downside to these first juvenile courts3. Decision solely based on the judge's opinion. 4. This type of court system, was more like social work than a juvenile courtII. A century ago, when the US created the first juvenile court system lawmakers recognized that youthful offenders differ from adult criminals.1. Young people act more impulsively2. 16 is usually the minimum age considered for a child to receive a death sentence. Through out my research I found that many people believe violent crimes are committed by children who come from poverty, lack of parental guidance, children exposed to violence in their home, have genetically received the trait from their parents, and children who use drugs and/or alcohol. (That is 16,000 children that may not have the opportunity to learn of the correlation between their actions and the consequences; they will be considered criminals for life. it indicates that children and adolescents process intense emotional situations in the part of the brain that is responsible for instinct and gut reaction. Citizen for the rest of their lifeA. They offer a more supportive atmosphere, where juveniles can receive counseling and continue their education, doing so among peers. Either way these are children we are talking about. The Statutory Rape Law, Prohibiting minors having sex10. Depending on the stated you live in certain offenses committed by anyone under 18 are automatically transferred into criminal court. Because of all these reasons, children are prevented from certain things including:1. Conviction in a criminal court can therefore cause long term serious complications for becoming a successful productive citizen after being released.
