Constitutional interpretations

Thomas Jefferson and James Madison were two great presidents in the history of the United States. Their political views and ideas were very similar. On the other hand, the two political parties of the early 1800's had two different views on how to interpret the constitution. Madison and Jefferson's interpretation of the U.S. Constitution is one thing that they agreed on thoroughly. While Jefferson and Madison were more towards a strict interpretation of the constitution there were also time when they interpreted it loosely. Madison and Jefferson had a pretty strict view on how to interpret the constitution regarding domestic affairs around the country. They both agreed on many issues. Some of the things that they agreed were in direct interpretation of the constitution were the repeal of the excise tax on whiskey, repeal of the Judiciary Act, and the way they viewed states rights. Jefferson saw the excise tax on whiskey and the Judiciary act unconstitutional. H


Much to the federalists liking, Jefferson continued with Alexander Hamilton's entire plan except for the excise tax while he was president. (Doc B) James Madison also ruled for the constitution when we denied signing a bill that was proposed to improve canals and roads. Federalists called the Hartford Convention in 1814 at the height of their dismay to discuss what they would demand from the federal government. The two parties were almost never in agreement. (Doc D) The federalists never agreed with the decisions of Jefferson or Madison and eventually at the end of the Hartford Convention the federalists party came to an end. Jefferson believed that the government had no right to decide what religion must be practiced which was a total separation between church and state. While Madison and Jefferson both viewed the constitution strictly they had their views in which they saw things loosely. e had strong views regarding states right because all states had the power to make their own laws as long as they didn't fall under the federal laws of the constitution. The Non intercourse Acts of 1806 and 1809 were both loose interpretations and both stopped importation of goods from different European countries. The constitution is against the growth of the nation while Jefferson thought it would be in the best interest so he sent Robert Livingston to France to buy it for $15 million. (Doc C) The Barbary Pirates was the first time Jefferson was loose on interpreting the constitution. Although the federalists never really agreed with the two presidents decisions today it can be agreed upon that Jefferson and Madison were two of the great presidents of the United States of America. In response to the Chesapeake affair the president passed the Embargo Act of 1807 which prohibited all foreign trade. (Doc H) Jefferson and Madison's strict interpretation was cause for many of the decisions regarding domestic affairs.
