ouisiana with the "Database Security Breach Notification Law" which was signed by Governor Blanco in 2005 on July 12, 2005 and became effective on January 1, 2006. This legislation requires notification to any Louisiana resident whose un-encrypted "personal information" was, or is reasonably believed to have been, acquired by an unauthorized person as a result of a "security breach." In addition, the notification must be made in the most expedient time possible and without unreasonable delay, consistent with the legitimate needs to law enforcement or any measures necessary to determine the scope of the breach, prevent further disclosures, and restore the reasonable integrity of the data system (Duplessis, 2005, Art. III).
In the Louisiana Constitution of 1974 there where few laws regarding the Internet privacy as a whole. The proclamation that best clarifies Internet privacy is in section 5 of the Louisiana Constitution declaring: ".... No warrant shall issue without probable cause supported by oath or affirmation, and particularly describing the place to be searched, the persons or things to be seized, and the lawful purpose or reason for the search. Any person adversely affected by a search or seizure conducted in violation of this Section shall have standing to raise its illegality in the appropriate court" (Article I, §5, p.3).
As modern times change many privacy acts are being put into play. Companies develop privacy technologies that help protect individual's identity and personal information while at the same time hackers and criminals find means to break these firewalls and breach laws. The same goes for people who believe everything is private. I believe that whatever something is posted on the Internet it becomes information for the world and anyone may obtain anything, even if something is deemed "private."
