counsel argued that kissing did not constitute an offence under the Immorality Act, but the magistrate were able to rule that such behaviour, especially in a 'dark secluded spot in a car was, infact against public morals and did indeed constitute an offence under the Act'. The government realised that cases similar to this would appear more often and not all would rule in favour of them; so the National Party went further and forbade 'all sexual activity falling short of intercourse between the races' with the Immorality Amendment Act in 1957. The major problem though, was deciding who was White and who was non-White. If the races were going to be completely separated, it was essential to know which race people belonged to. Another Act was necessary to classify the entire population, thus in 1950, the Population Registration Act was passed. "...this Act is the basis of the whole policy of apartheid..."-Malan. Originally, there were 3 racial groups you could be classified as: White (one who in appearance obviously is, or who is generally accepted as white), Native (one who is in fact or is generally accepted as a member of any tribe of Africa) or Coloured (one who is not a White or a Native). However, races such as Chinese or Indian were rather different from people descended from Khoikhoi-Afrikaner ancestors, so the authorities in 1959 accepted 7 different categories of Coloureds. They were: Cape Coloured, Cape Malay, Griqua, Indian, Chinese, Other Asiatic and Other Coloured. The effects of the Acts, socially, especially the Population Registration Act was devastating.
