This case is not an airtight example of the ill treatment of the mentally disabled since Cruz had scored an 83 on the IQ exam upon entering prison in 1989. It is possible that Cruz purposefully scored lower on the second IQ test in order to get sympathy. If this is indeed the case then Cruz is not mentally disabled, he just has a very desperate lawyer.
