Homosexuality

             It has been estimated that approximately one percent of the population in Canada is homosexual. Although this proportion may seem insignificant, it represents over 314 000 people. Canada is known worldwide as one of the freest countries, but there are still restrictions in the law that limit a person's liberty based on sexual preference. Although common-law relationships between same-sex couples are recognised in almost every province, the term marriage is one that the government will not apply to them. Does this not go against all Canadian morals and standards opposed to discrimination? Everyone ought to have the right to be legally married; sexuality should not be an issue.
             Everyone has a right to be happy. Everyone has a right to live however he or she wants, as long as he or she does not infringe on the rights of another. This is shown in Section 2 of the Canadian Human Rights Act, as it states:
             ...all individuals should have an opportunity equal with other individuals to make for themselves the lives that they are able and wish to have, and to have their needs accommodated, consistent with their duties and obligations as members of society, without being hindered in or prevented from doing so by discriminatory practices based on...sexual orientation....
             However, the Canadian definition of marriage by law is the union of "one man and one woman to the exclusion of all others." This definition came from the 1866 case Hyde vs. Hyde, which took place in the United Kingdom's Courts of Probate and Divorce. Nevertheless, by not recognising marriages between people of the same sex, this definition and the Canadian Human Rights Act contradict each other. The explanation of marriage from 1866 is preventing same-sex couples in the country from obtaining the happiness that they want and deserve, the happiness which is a right that they are entitled to.
