The amendments impose obligations on parties to notify the Attorney General of Canada if they anticipate the disclosure of sensitive information of which could be injurious to international relations or national defense, and they give the Attorney General the powers to assume carriage of a prosecution, and to prohibit the disclosure of information in connection with a proceeding for the purpose of protecting international relations or national defense and security."
             In making these amendments, the government had to equally exclude the opportunity to access this information through the Access to Information Act or Privacy Act. This is incase parties tried to use the backdoor to gain sensitive information. This amendment particularly generated concern from the Privacy Commissioner of Canada because this power could easily be used to go beyond what is considered the protection of national security or international relations. But the greatest concern of all, as stated by George Radwanski (Privacy Commissioner of Canada) is that these provisions relating to the amendments of the Privacy Act, is the way they are drawn. He states that there is nothing for the law to prevent a minister from issuing a certificate pertaining to an individual, but to an entire agency or department, or for the government as a whole#. I see how this would be rather a big problem relating to aspects that concern the limitations on how the information could be used or for what reasons they would be used in criminal procedures or the courts.
